Dan Gillmor breaks down the exploitative side of participatory culture

Dan Gillmor on the Center for Citizen Media blog writes about the good and bad about online group-based participation.

The good happens when community is created and supported:

People do things for many reasons, but it’s always about getting something of value back. The value may be a psychic reward of doing something good for someone else. It may be ego. It may be money, or the ability to save money. In community-driven websites it may be contributing a tiny bit of effort to something that gives the overall community, and thereby individuals, great value. Usually it’s a combination.

The bad happens when the work of some is exploited by others, such as :

the tendency of site owners to rely on free labor. The method goes roughly this way: “You do all the work and we’ll take all the money, thank you very much.” …

You are invited to translate the site into another language, because you are such a generous person. If you are a badass programmer, however, you are invited to apply for a job and make some actual money.

… If you are generous enough to do this kind of work for free, please consider doing instead it for a nonprofit site of some sort. Please don’t be giving away your time to mega-wealthy media barons.

Even when our intent is to make things better for ourselves and our online community, mega-wealthy media barons are often making money from our labor (see MySpace). Giving away our labor is what we (those who use the internetz tubes) do everyday when we rank items on Amazon or Netflix, and participate in MySpace, Facebook, and other social networking sites, improving their services. But at least in these cases, participants get something positive out of it, even if they don’t get paid for their efforts.

Does saving culture violate copyright law? Often the answer is yes.

Which of these is acceptable under copyright law? Republishing books when their authors are almost definitively dead to save a dying culture? Publishing collections of unpublished ephemera, such as love letters and candid photos when the creators are unknown? Ensuring that historic sound recordings are preserved? Or repurposing the writings of a dead author to sell products completely unrelated to that author, if the heirs give permission?

Oddly enough, even though the last option seems somehow wrong, it is the only option that is presently acceptable under U.S. copyright law. Some actual examples of cultural preservation that are culturally acceptable, but not legal revolve around orphan works, likely copyrighted works where it is difficult or nigh impossible to determine ownership. In the U.S., many works published from 1923 and onward fall are orphaned. As described by Lawrence Lessig,

‘”orphan” works [] “fall into a black hole of regulatory uncertainty.””You have films from the 1930s and you can’t identify who the copyright owners are so you can’t restore them and make them accessible,” he said. “What we’re talking about is this class of work where there is no known present owner to come forward. So the work cannot be made available.”‘

Republishing books when their authors are almost definitively dead to save a dying culture?

The National Yiddish Book Center was founded by Aaron Lansky, author of Outwitting History, who in response to

thousands of priceless Yiddish books – books that had survived Hitler and Stalin – were being discarded and destroyed. As an older generation passed on, more often than not their precious Jewish volumes were literally thrown in the trash by children and grandchildren unable to read the language. An entire literature was on the verge of extinction.

The Center [has] recovered … 1.5 million volumes…. The Center’s achievement has been hailed as the “the greatest cultural rescue effort in Jewish history.”

Not only has the Center collected books, it also republishes them from the Stephen Spielberg Digital Library:

[with] pioneering program to digitize the titles in our collection and make high-quality reprints available on demand. Our easy-to-use online catalog means that Yiddish, once the most endangered of literatures, is now the safest and most accessible.

Most of the books republished are within the copyright term either in the the U.S., or in Europe, such as Germany, assuming death in 1945, under copyright “protection” until 2015. Should the Center be tracking down the heirs of all of the authors they republish? According to copyright, the answer is yes, because there isn’t an exception for saving culture from destruction. To follow copyright formalism to such a degree is a strange combination of sad and ironic and disturbing. It would be wrong to allow the words of those killed in the Shoah to be a modern-day Ozymandias, works crumbling away into nothingness.

Publishing collections of unpublished ephemera, such as love letters and candid photos when the creators are unknown?

While the National Yiddish Book Center collects and reprints items to save an entire culture, on the other hand, Found Magazine collects and republishes the ephemera of life, such as shopping lists and notes passed in class. The publishers print the magazine “so that everyone can check out all the strange, hilarious and heartbreaking things people have picked up and passed our way.” The culture being preserved in Found is the type that we all create — and throw away or forget about (or in the case of Dirty Found, perhaps items that people would prefer to ignore ever existed).

Considering the items are found items (hence the title) and mostly anonymous, the publication does not ask for permission of the copyright owner. And who would think about their to-do list as being copyrighted? For 120 years? Found Magazine purposely collects items likely to not last 120 hours or days, let alone years, so readers can revel, weep, and laugh at the banalities of everyday life.

Ensuring that historic sound recordings are preserved?**

In the U.S., sound recordings made pre-1972 will not enter the public domain until 2067. This means that all of the early recordings, including those with significant historical and cultural significance are locked up by copyright. Examples include early blues recordings, regional folk songs, and other materials that there may be no living person with direct knowledge of the songs. Considering that format shifting isn’t allowed, if the recordings dissolve or their are no more players — too bad! On the other hand, in the U.K. (at present) has a copyright term of 50 years for sound recordings, allowing for early recordings to be republished and angering aging U.K. rockers.

Some of the only clearly public domain sound recordings/ transcripts are from the WPA / Federal Writers’ Slave Narrative Project, so think about all of other possible culturally significant sound recordings that are locked up until 2067.

For example, the band, Tomahawk, based their latest album, Anonymous, on the Native American recordings researched by its guitarist, Duane Denison and Hank Williams III. Tomahawk’s label’s official site states

[Anonymous] reverentially explores and reinterprets the darker, more recessed ancestral music created by North America’s indigenous people, the title reflects the countless individuals who contributed to these songs but went un-credited throughout history. … Duane began to research [Native American] music ; … he found books that were written around the time of Teddy Roosevelt’s presidency, a period in U.S. history when Indian culture and artifacts were in vogue. The books, dated to the early 20th century, recorded transcriptions of the songs [used on the album].

Repurposing the writings of a dead author to sell products completely unrelated to that author?

On the other hand, often when famous people die, their images and words are used in ways that can go against what fans and critics think fits. For example, after Dr. Seuss died, his works were commercialized by his widow. Or in a recent case, the works of Frank Zappa are being limited by his.

In another example, with larger cultural resonance, since the death of Martin Luther King, his family has authorized the use of his copyrighted works in some very non-civil rights ways … and has limited use of his words. The family was left with little money, so it makes sense why they would view MLK’s works as their legacy, after all, under the law, it belongs to them — not the public at large.

In response to one Martin Luther King ad for trucks, one critic stated:

“I feel a little violated when I watch it … I don’t mind when they have a tent
sale on President’s Day, but those guys have been dead for 200 years. I’m not
sure I’m ready for a Rosa Parks sale-a-bration.”

Presently, copyright law is about the rights of individuals to control … , without an allowance for the idea of cultural ownership for works within the copyright term. This has led to the creation of licensing schemes like Creative Commons — considering how difficult it is to officially give a work to the public domain. And to the serious problem of orphan works, leading to the slow melting away of culture, especially 20th century culture, due to our fears of copyright. At least there are people and organizations like the National Yiddish Book Center willing to risk violating copyright to preserve culture.

Let us praise those that help preserve culture, not bury them, as copyright law does by default.

Romance novel fans catch plagiarist black-footed ferret!

So what possibly could romance novels featuring awkwardly-smooth-talking fictional Native Americans, plagiary, fans, and black-footed ferrets have in common? One bizarre detective story by a group of go-getter romance novel fans on the blog, Smart Bitches, Trashy Books! In an extensive investigation of the writings of Cassie Edwards, our intrepid detectives found many instances of language matching without quotation, including from an science-based nature article about ferrets from Defenders magazine. (quick summary here at GalleyCat)

While I can’t speak for the Smart Bitches, I would think that part of their motivation was to protect their fan community. And in response, they’ve gained a great deal of fame for their work. In an odd twist, the plagiarism has lead to the author of the original ferret article, Paul Tolme, to find a wider audience for his writing through an article in Newsweek about this situation (Dear Author has detailed profiles of all of the known uncited). The scandal has also led to greater awareness of the black-footed ferrets, including a donation challenge by another well-known romance novelist, Nora Roberts.

But this case also points out the difference between law and culture. Culturally, we generally accept that when people use the words of others there should be some type of attribution. (For example, while early Creative Commons licenses had attribution as an option, it was later incorporated into all licenses because almost no one didn’t want their work attached to their name.) However, U.S. law doesn’t require attribution to the author (Rebecca Tushnet has written an article explaining why she thinks attribution should not be incorporated into copyright law).

As posted on Smart Bitches , Dear Author, and MediaBistro’s GalleyCat, the attorney for Cassie Edwards conflates these two issues, by stating that her use of the writings of others could be considered fair use, (“copyright fair-use doctrine permits reasonable borrowing and paraphrasing of another author’s words, especially for the purpose of creating something new and original”), and anyway attribution standards vary and romance novels don’t attribute:

“Although it may be common in academic circles to meticulously footnote every source and provide citations or bibliographies, even though not required by copyright law, such a practice is virtually unheard of for a popular novel aimed at the consumer market.”

Fans of course have of examples proving this standard for romance novels wrong.

But if glossing over attribution mattered so little, last year’s Harvard novel plagiarism scandal would matter little to readers; after all, if Kaavya Viswanathan had just attributed passages to their originators the whole thing wouldn’t have mattered. *snark voice* (Rachel Smydra argues that part of the problem are the attribution standards in “chick lit”).

Especially when it is easy to do so, let’s (at least) give credit where credit is due. Thanks in this case to the intrepid Smart Bitches!

Oh, and by the way? Nobody cares about Facebook.

So the Interwebz’ collective panties are in a twist as a result of a recent study that says essentially that MySpace still rules (and I mean significantly) when it comes to web traffic, despite Facebook’s dominance in the media.

Traffic analysts Hitwise released numbers today indicating that things are not as they might seem. Apparently, all the Facebook hype has not translated into a huge growth in social network market share among US users. Hitwise says that Myspace received 72.32% of US visits to the top ten social networks in December 2007, while Facebook received just over 16%.

Even so, Facebook is still the media/tech geek darling, with CEO Mark Zuckerberg on board to bore the hell out of people until Harold and Kumar shows up speak at SXSW Interactive in March.

But honestly, the Facebook vs. MySpace war is a rather pointless one. People will go, ultimately, where the content is, and that’s where MySpace rules. All the goofy applications in the world won’t make up for that. As long as musicians stream new music and film companies post exclusive trailer on MySpace, MySpace is where people will spend their free time. Until something better comes along.

I have no particular affinity toward one or the other as a user.But for anyone interested in using either for marketing purposes, this is a game-changer.

Facebook and the culture of total transparency

So … did ya watch the 60 Minutes interview with Facebook founder Mark Zuckerberg on Sunday night? You didn’t? Well that makes you, me and a few million other people, since it brought 60 Minutes its lowest ratings of the year thus far. Big surprise? Not really. I don’t think most casual users care so much about the creator of Facebook, even if they have an account, and those that are more invested in it (web marketing professionals and start-up execs, etc.) don’t necessarily hold Zuckerberg in such high regard.

So yeah, the Facebook piece was a bomb for CBS, but that’s not even the point of this post. Even if you could care less about Mark Zuckerberg, if you have a Facebook account – or a My Space account, or a Friendster account, or even just a blog – the issue of transparency in social networking sites (i.e. letting your online “friends” in on all of your business) is a huge issue.

It’s probably a bit ironic – if not hypocritical – for me to say this: a person with two blogs and six social networking profiles, and who spends a good part of her working day researching this kind of stuff, but I find this new culture of 100% online transparency to be pretty freaking annoying.

And this is really all Facebook’s fault. While Friendster, My Space and other sites allow users to have a selective level of anonymity through online aliases, Facebook allows no such thing, your full, real name is a required part of your profile, and your work, personal information and interests are automatically served up for personal consumption on news feeds until you select to have that particular feed removed.

This insistence on total tranparency, combined with Facebook’s very aggressive approach of mining this information for marketing purposes had certainly won a large share of detractors, which has been well documented. It’s annoying to me as a user; when I decided to take my relationship status off of Facebook (I use it for professional networking more than socializing) I got three messages from people asking there was a new “special guy in my life.” Three!

But, as an individual who manages a Facebook group for Association of Women Journalists, I will readily admit I’ve taken advantage of user’s openness about their interests to invite them to the group. And it’s an inevitability that I will be advocating a similar use of Facebook at my current job. Far from being dooced, I was actually hired in part because of my professional experience with blogging.

Total tranparency online as a default is certainly problematic when it comes to privacy issues, but as a culture, we’re moving more and more in that direction. Going back to the “good old days” of online anonymity isn’t really an option when you’ve got an entire generation of online users who are used to throwing their business up online to a “friends” list that consists of friends, relatives, c0-workers and total strangers.

Not to mention, anonymity on the web these days is seen as suspect. If one is not open about your identity on some level it’s assumed you have something to hide. (which is true, in a lot of cases)

But at the same time, I find myself not really caring if someone on my friends list just ate a cheeseburger two minutes ago or posted to a group of Clay Aiken fans, and I am sure my online friends feel the same way about my activities, and I shouldn’t have to work to not make that the default for my online experiences.

“Selling Out” and YouTube: Chocolate Rain and OK Go

If you are trapped in the modality of “you are such a sell-out!” then two of the biggest YouTube success stories, Chocolate Rain and OK Go are nothing more than sell-outs.

OK Go created a video for their song “Here It Goes Again,” (first video above) featuring the band doing a synchronized dance routine on treadmills in one-take has been seen over 28 million times on YouTube. The video’s success led to the song being included on several television shows and commercials (including the Nike/Apple ad above), and worldwide success. Does this make the band sell-outs?

Tay Zonday performed his original song “Chocolate Rain” in a YouTube video (above) that became a meme. Chocolate Rain lead to several parody videos (including the ones shown above by Green Day and on VH1’s Best Week Ever), and Tay Zonday created a new version of the song to advertise Dr. Pepper called Cherry Chocolate Rain (above). Tay Zonday has created a song that he has finally made money from. On his myspace page, he explains why he Creative Commons licensed this song: “”I want nonprofit radio and small mom/pop cafes to be able to play my music for free. But I also want giant corporations who can afford to give me a dime or two to pay fair royalties.” Is he a sell-out?

According to the present-date neutrality-questioned Wikipedia entry, “selling out” is

Selling out refers to the compromising of one’s integrity, morality and principles in exchange for money, ‘success’ or other personal gain. It is commonly associated with attempts to increase mass appeal or acceptability to mainstream society. A person who does this, as opposed to following the original path s/he laid (or claimed to lay) out for him/herself, is labeled a sellout and regarded with disgust and immediate loss of respect. Selling out is seen as gaining success at the cost of credibility.

So to put this simply, if you get paid for your artistry, you are a sell-out. The term “sell-out” is placed upon many artists, but especially on those in the music industry (and some consider it to be tied to “rockism” — the need to reduce[] rock ‘n’ roll to a caricature, then uses that caricature as a weapon.”). After all, the critics that judge “the best” or most authentic — someout equalling non-sellout and the true auteur of music, usually privilege certain types of genres and artists around class, gender, and race (metal, disco, dance, pop are not “real” music; The Beatles, Stones, and Led Zeppelin are the bestest bands EEVVERRRR!!!11!!).

Not to say that I also don’t wonder what made “Bob Dylan, respected countercultural artist, [] choose to sell panties”, or think about how U2 determines the line between crass commercialism and not, or understand why Of Montreal considers “selling out isn’t possible”. It is indeed possible for something (or someone) to have an artistic vision and then lose it (RTD, you in particular for your incessant Mary-Sue-ism!), but tying lost talent with money doesn’t frequently tell the whole story.

In the case of both Tay Zonday and OK Go, if they weren’t going to “sell out” would that have prevented others from making money from their music? Of course not! YouTube would have continued to make ad dollars and increased the value of the service, making the site more valuable when it was sold. Yes, some of the licensed stuff isn’t, well … the stuff that fans would choose to license. But it isn’t fans’ bills that need are getting paid from another Apple ad. And that is really what it comes down to, and limiting critiques to “selling out” does nothing except for making the critic feel more special. Talent sometimes fades away, sometimes grows, but bills are forever.

What to Watch Instead of Late-Night TV During the Writers Strike: Look to the U.K., India, Japan & Korea!

With the return of much of late-night television, including the Daily Show and the Colbert Report, the writers’ strike will be ending soon, right? Not likely with the recent cancellation of the Golden Globes. Networks will be running out of new scripted shows (it seems like with the exception of original-flavor Law and Order), so what to watch?

I am surprised that the networks are not looking globally to:

  • the U.K. for programs in English? Why not show the original Office as a replacement for the U.S. version? Or Mile High as a replacement for dramatic comedies? MI-5 (Spooks) as a replacement for 24? Coupling (U.K.) for sex comedies? Life on Mars for all of those new slightly wacky crime-fighting shows (sans vampire)? Shows about how “everyone in this small town is crazy but me” like Hamish Macbeth or The Vicar of Dibley? Or what about all of those Masterpiece Theatre – like costume dramas? Shows that would fall into the “Murder in the Morning” genre? Shows that are detail-oriented, like Foyle’s War? BBC America can’t possibly show all of these! (clip from Mile High)

  • to India and the productions of Bollywood? There are tons and tons of new material being produced. Unlike the U.K., the films are not in English, and are crafted to suit a different sensibility (greatly simplified: lots of song and dance, great costumes, no kissing). However, considering the large desi audience in the United States, you may be able to find TV programming from Namaste America (or others). After all, it’s new to you! (clip of “Dhoom Again” from Dhoom 2)

  • to Japan, the worldwide producer of anime and kawaii? There is so much Japanese pop culture, including TV and movies, that are not presently being shown on U.S. television, especially shojo / shoujo anime, which is directed towards girls and women. Consider checking out the teen psychological “evil fairy tale” drama Utena (clip above) or CardCaptor Sakura.

  • or to Korea, which in addition to having some of the best new r&b out there, also has the best soaps, exported as part of the “Korean Wave“. Korean Soaps (Korean Dramas or k-dramas) are usually like a cross between U.S. soaps and Jane Austen, where couples can’t be together because someone’s grandma doesn’t like the other person, or someone’s drunk relative killed the other person’s parent, such as the presently airing Likeable or Not. (The parodies on MadTV are strikingly accurate!) Others are more fanciful, like The Palace (Goong), which imagines a modern-day Korean royal family, complete with an arranged marriage (clip above). Korean dramas with subtitles are shown in many places in the U.S. , including in Chicago, Los Angeles, San Francisco, Hawaii, and New York.

I’m not sure why networks didn’t try these options instead of rushing to get out more bad reality TV. Perhaps execs thought the strike would be over soon — or incorrectly thought that U.S. audiences aren’t ready for something new and different. But I think you can tell what I’ll be watching, instead of guiltily watching Colbert without his writers. And who knows how quickly I will be going back to U.S. network TV, considering all of the options out there (even excluding video-sharing sites).

You will notice that clips of shows are included in this post, but if the writers’ strike shows us anything, it is that people want to be fairly compensated for their work. All of the shows linked you’ve never heard about can either be purchased on DVD or rented from Netflix, or can be watched on broadcast or cable TV.
